Las herencias son ese trámite que se realiza cuando alguien fallece y debe transmitir sus bienes, derechos y obligaciones a ciertas personas, que se denominan herederos. El régimen jurídico que las regula es el Derecho de Sucesiones.

La legítima de una herencia es esa parte de la que el testador no puede asignar a sucesores a título particular. Por ley está reservada a sus herederos forzosos. Es decir, hijos y descendientes, ascendentes y a su pareja.

La legítima varía de una comunidad autónoma a otra; el derecho de sucesiones tiene variantes sustanciales en los distintos ordenamientos jurídicos. En Catalunya tenemos un derecho civil propio, siendo la cuantía de la legítima de una cuarta parte del total de la herencia.

El derecho civil común, regula la cuantía de la legítima en dos tercios.

Aquellas personas que heredan pueden clasificarse en dos tipos: los herederos y los legatarios. Los herederos son aquellos que suceden al fallecido en derechos y obligaciones. Son sucesores a título universal y elegidos por el testamento del difunto o establecidos por la ley.

Una vez realizados todos los trámites pertinentes llega el momento de decidir si aceptar o no la herencia. Este tipo de aceptación puede ser simple o a beneficio de inventario.

La simple implica que el heredero reciba todos los bienes, respondiendo con los suyos propios en caso de que hubiera deudas.

La aceptación a beneficio de inventario, en cambio, implica que el heredero responderá ante las deudas hasta el límite del valor de los bienes que ha heredado. Si las deudas superan dicho valor, el heredero no se hace responsable de las mismas.
