La negociación entre herederos es la mejor vía para la tramitación o reparto de una herencia. Aunque los procesos sucesorios suelan conllevar conflictos familiares, siempre debemos tratar de llegar a un acuerdo. Recordemos que una herencia sitúa a los coherederos en una situación de conflicto de intereses. Así, cuantos más bienes y derechos correspondan a un heredero, menos tocarán al resto.

Tengamos en cuenta que si acudimos a los tribunales será un juez quien tome las decisiones relativas a la herencia. Para ello empleará criterios técnico-jurídicos, que suelen guardar estrecha relación con criterios económicos. Así, la distribución judicial de una herencia siempre va a ser fría y objetiva.

Al margen de la cuestión emocional, los repartos judiciales se realizan conforme al relato fáctico aportado por las partes. Esto significa que la decisión del juez no tiene por qué satisfacer a todos los involucrados. De hecho, lo más frecuente es que:

Solo favorezca a la parte que haya defendido en juicio sus intereses con mayor pericia, perjudicando al resto de los implicados. Esto requiere la asistencia de un abogado especializado en herencias.
O incluso no llegue a satisfacer completamente a ninguna de las partes.

Ante la decisión judicial solo cabe presentar los correspondientes recursos. Pero de nuevo será otro juez o tribunal quien tome las decisiones. Dicho de otro modo, los coherederos tendrán poca capacidad para decidir el destino de la herencia, más allá de presentar su relato fáctico y sus pretensiones.

En contraposición, la negociación entre herederos permite a todos los interesados participar en las decisiones sobre el destino de la herencia. Esto permite un reparto más satisfactorio, evitando perjudicar a nadie más de lo imprescindible y, por tanto, limitando la conflictividad del proceso.

Cada proceso de negociación es un mundo y dependerá de los coherederos implicados y la composición de la herencia. Sin embargo, lo más habitual es empezar analizando los intereses de cada uno de los partícipes para establecer lotes tan satisfactorios como sea posible.

La ventaja de la negociación entre herederos es que facilita acuerdos que implican un reparto respetuoso con las preferencias de las partes.
Por otro lado, es fácil que tengan que intervenir otros profesionales en el proceso de negociación. Así, probablemente tendrán que entrar en juego peritos y tasadores, además de un notario si queremos formalizar el acuerdo o existen bienes inmuebles en el haber hereditario.

En algunos casos se puede cerrar la negociación en un cuaderno particional de corte privado. Pero en otros casos se deberá elevar a escritura pública. Por ejemplo, esto ocurre cuando existen inmuebles en la herencia, que además deberán ser inscritos en el Registro de la Propiedad.

Al contar con asistencia letrada, el asesor podrá explicar a los partícipes si en su caso es necesario o no formalizar una escritura pública o realizar inscripciones en Registros Públicos.

Además, podrá verificar el cuaderno particional o cualquier otro pacto para verificar que se adapta a la legalidad. Esto impedirá que posteriormente se impugnen los acuerdos adoptados, aportando seguridad jurídica a la operación.
